1. The short version
The rest of this page is the detail. It's a binding agreement between you and We Dine, and you accept it by creating an account.
2. Who can use We Dine
You need a valid email address and a Venmo or Zelle account in your own name to be paid. Those services set their own eligibility requirements, including minimum age, and we can't pay you if you don't meet them.
If you are under the age of majority where you live, a parent or guardian must review and agree to these terms with you, and payouts must go to an account they control.
Some participating restaurants serve alcohol or restrict entry by age. Their rules apply regardless of anything here.
One account per person. Don't create additional accounts to claim more spots, earn more referral bonuses, or get around a suspension.
3. How the program works
Restaurants open selected nights and set a cash-back percentage. You claim a spot, which reserves your rate. That rate is locked at the moment you claim — if the restaurant changes its offer later, you keep the rate you claimed.
You then dine as an ordinary guest, photograph your itemized receipt, and complete the survey. Cash back becomes available once the survey is complete.
Claiming a spot is not a restaurant reservation. Where a restaurant takes bookings, you're responsible for booking a table. There's no penalty for claiming a spot and not going, but please cancel so someone else can use it.
4. Being a secret reviewer
The value of this program depends on you being indistinguishable from any other guest. You agree that you will:
- Not tell staff, management, or owners that you're reviewing, before or during your visit;
- Not identify yourself as a We Dine diner to the restaurant at any time;
- Not request special treatment, free items, or a discount at the table;
- Not attempt to influence your own service in order to affect your review; and
- Answer every question honestly, including when the answer is unflattering.
Your identity is not shared with restaurants. They receive your answers, your receipt, and the server named on it — not your name, email, phone number, or payout details.
5. Receipts
Every survey must be supported by an itemized receipt from your own visit, on the date of that visit. You agree not to submit a receipt that is altered, borrowed from someone else, reused, or from a meal you didn't pay for.
Receipts are checked automatically and may be flagged for human review. A flagged receipt doesn't mean we think you did something wrong — old dates, unusual totals, and unclear photos are common reasons.
6. Cash back and payment
Cash back is calculated as your locked rate applied to the receipt total, and it is earned only when you complete a survey supported by a valid receipt. It has no cash value before then and is not a credit, deposit, stored value, or currency.
You choose where it's sent — Venmo or Zelle. It's your responsibility to give us accurate payout details; we're not liable for money sent to an incorrect handle or address you provided. Your Zelle email must match your account email.
We aim to pay promptly after you claim. During the current beta, payouts are processed manually and may take several business days.
Taxes are yours. Cash back you receive may be taxable income. You're responsible for reporting it. If your annual earnings reach the threshold where we're required to report them, we may ask you for a W-9 and may withhold payment until you provide it.
7. When we don't pay
We may withhold or reverse cash back, and may suspend or close your account, if we reasonably determine that:
- A receipt was altered, duplicated, or not from your own visit;
- A survey was completed without actually dining, or answers were fabricated;
- You identified yourself as a reviewer to the restaurant;
- You used multiple accounts, or abused the referral system; or
- You otherwise breached these terms.
If we withhold payment, we'll tell you why and you can respond. Contact support@wedineapp.com within 30 days and a person will review it. We'd rather correct a mistake than lose you over one.
8. Referrals
Sharing your referral code with someone who creates an account doubles your next claimed discount. Referral bonuses are for genuine new diners. Creating accounts to refer yourself, or bulk-distributing your code through spam, voids the bonuses and may close your account.
9. Your reviews
You keep ownership of what you write. By submitting a survey you give We Dine and the restaurant you reviewed a licence to use, store, and act on your answers for the purpose of operating the program and improving the restaurant.
We may use anonymised, aggregated survey data — averages and benchmarks — for reporting and research. This never identifies you.
We don't edit reviews, and we don't remove one because a restaurant dislikes it.
10. Closing your account
You can delete your account at any time from the app: Me → Delete my account. It takes effect immediately.
Claim any cash back before you delete. Unclaimed cash back is forfeited on deletion and cannot be recovered.
Surveys you already submitted stay with the restaurant, with your identity permanently removed from them. Our privacy policy explains this in more detail.
We may suspend or close your account for breach of these terms, or discontinue the program entirely, on reasonable notice. If we close the program, we'll pay out cash back you've properly earned.
11. What we don't promise
We Dine is a platform, provided as-is. We don't control restaurants and aren't responsible for the quality of your meal, your service, or anything that happens during your visit. We don't guarantee that spots will be available, that any particular restaurant will participate, or that the app will be uninterrupted or error-free.
Your meal is a transaction between you and the restaurant. Disputes about food, service, or billing are between you and them.
12. Limits on liability
To the fullest extent permitted by law, We Dine's total liability to you under these terms is limited to the cash back you properly earned and had not yet been paid at the time the claim arose. We are not liable for indirect, incidental, or consequential damages.
Some jurisdictions don't allow these limits, in which case they apply to the extent permitted.
13. Changes to these terms
We may update these terms. If a change materially affects your rights, we'll notify account holders by email before it takes effect. Continuing to use We Dine after that constitutes acceptance. Changes never reduce cash back you've already earned.
14. Disputes
Talk to us first — support@wedineapp.com. Most problems are a misread receipt or a payout detail typo, and both are quick to fix.
These terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any dispute not resolved informally will be brought in the state or federal courts located in New York County, New York City, and both parties consent to the jurisdiction of those courts.
15. General
These terms, together with our privacy policy, are the entire agreement between you and We Dine about the program. If a provision is unenforceable, the rest survives. Our not enforcing a provision isn't a waiver of it. You can't transfer your account or these terms to anyone else.
